These Terms of Service govern your use of the Shomer Health platform, including the AI-powered SMS triage service, the shomer.health website, and all related services. By using Shomer Health, you agree to these terms. Please read them carefully before use.
⚠ IMPORTANT: Shomer Health is NOT a substitute for emergency medical care. If you are experiencing a medical emergency, call 911 immediately. The Shomer Health AI triage assistant does not diagnose conditions, prescribe medications, or provide medical advice. All clinical decisions remain the sole responsibility of your licensed healthcare provider.

1. About Shomer Health

Shomer Health is an AI-powered after-hours clinical triage communication platform operating under an existing Tennessee limited liability company, doing business as Shomer Health, located in Spring Hill, Tennessee. We provide after-hours patient triage routing services exclusively on behalf of subscribing Direct Primary Care and independent medical practices.

Shomer Health is a technology platform — not a healthcare provider, medical practice, or clinical service. We do not provide medical care, clinical advice, or treatment of any kind.

2. Acceptance of Terms

By texting the Shomer Health SMS triage number, visiting shomer.health, or using any Shomer Health service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our services.

These terms apply to patients communicating via SMS, healthcare providers subscribing to the platform, and all visitors to shomer.health.

The Shomer Health AI triage assistant is not a licensed medical professional. It does not diagnose medical conditions. It does not prescribe or recommend medications or treatments. It does not provide medical advice. It collects symptom information and routes urgency only. Nothing communicated through the Shomer Health platform constitutes medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition.

In the event of a medical emergency, do not use the Shomer Health SMS triage service. Call 911 immediately or go to the nearest emergency room.

All content, technology, software, systems, clinical frameworks, AI logic, triage methodologies, brand elements, and materials associated with Shomer Health are the exclusive proprietary property of Shomer Health and are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, reverse engineer, or create derivative works from any Shomer Health intellectual property without express written permission. Unauthorized use of Shomer Health intellectual property may result in legal action.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHOMER HEALTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM RELIANCE ON AI TRIAGE RESPONSES, MISSED OR DELAYED MEDICAL CARE, OR ANY CLINICAL OUTCOME.

Shomer Health's total liability for any claim arising from these Terms or your use of the platform shall not exceed the amount paid by your provider for the Shomer Health service in the three months preceding the claim.

Shomer Health is a communication and routing tool only. Clinical outcomes and patient care remain the sole responsibility of the licensed healthcare provider.

10. Disclaimer of Warranties

THE SHOMER HEALTH PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SHOMER HEALTH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Indemnification

You agree to indemnify, defend, and hold harmless Shomer Health and its officers, employees, agents, and partners from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the platform, your violation of these Terms, or your violation of any applicable law or third-party rights.

12. HIPAA and Privacy

Shomer Health operates as a Business Associate under HIPAA. All patient health information is handled in accordance with our Privacy Policy and applicable HIPAA requirements. Healthcare providers using the platform must execute a Business Associate Agreement with Shomer Health prior to any PHI being processed through the system.

13. Termination

Shomer Health reserves the right to suspend or terminate access to the platform at any time for violation of these Terms, non-payment of subscription fees, or for any other reason at our sole discretion with reasonable notice.

Provider subscriptions may be cancelled at any time. Upon cancellation, access to the platform will continue through the end of the current billing period.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Maury County or Davidson County, Tennessee, at Shomer Health's election.

15. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will update the Effective Date at the top of this page. Continued use of the Shomer Health service after updated Terms become effective constitutes acceptance of the updated terms.
